Volcanotes Terms of Use

1. Introduction

Welcome to Volcanotes ("we," "our," or "us"). These Terms of Use ("Terms") govern your use of the Volcanotes mobile application (the "App") and related services (collectively, the "Service").

By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

2. About Volcanotes

Volcanotes is a task management application that helps users organise and prioritise their tasks through a visual "heating up" system. The App provides both free and premium features to enhance productivity and task management.

3. User Accounts

3.1 Account Creation

  • You may create an account using Sign in with Apple or other approved authentication methods

  • You must provide accurate and complete information when creating your account

  • You are responsible for maintaining the confidentiality of your account credentials

3.2 Account Responsibilities

  • You are solely responsible for all activities that occur under your account

  • You must notify us immediately of any unauthorised use of your account

  • You must be at least 13 years old to create an account

4. Acceptable Use

4.1 Permitted Use

You may use the Service for personal, non-commercial purposes to manage your tasks and productivity.

4.2 Prohibited Activities

You agree not to:

  • Use the Service for any illegal or unauthorised purpose

  • Violate any applicable laws or regulations

  • Interfere with or disrupt the Service or servers

  • Attempt to gain unauthorized access to the Service

  • Use the Service to store or transmit harmful, offensive, or inappropriate content

  • Reverse engineer, decompile, or disassemble the App

  • Remove or modify any proprietary notices or labels

5. Subscription Terms

5.1 Lava Mode Premium Subscription

  • Our premium subscription ("Lava Mode") provides additional features including expanded task capacity, custom heating rules, recurring tasks, and default settings customisation

  • Subscriptions are available on monthly or annual terms

  • Payment will be charged to your Apple ID account at confirmation of purchase

5.2 Auto-Renewal

  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period

  • Your account will be charged for renewal within 24 hours prior to the end of the current period

  • You can manage your subscription and turn off auto-renewal in your App Store Account Settings

5.3 Free Trial

  • We may offer free trial periods for premium features

  • You may cancel during the trial period to avoid charges

  • If you don't cancel, you'll be charged the applicable subscription fee

5.4 Cancellation and Refunds

  • You may cancel your subscription at any time through your App Store account

  • Refunds are subject to Apple's refund policy

  • Upon cancellation, you'll retain premium access until the end of your current billing period

6. Content and Data

6.1 Your Content

  • You retain ownership of all task data, notes, and other content you create in the App

  • You grant us a limited license to store, process, and display your content solely to provide the Service

  • You are responsible for the accuracy and legality of your content

6.2 Data Backup

  • While we implement data backup measures, you are encouraged to maintain your own backups of important information

  • We are not responsible for any loss of your data

7. Intellectual Property

7.1 Our Rights

  • The App and Service, including all software, designs, text, graphics, and other materials, are owned by us and protected by intellectual property laws

  • Our trademarks, including "Volcanotes" and our logo, may not be used without our written permission

7.2 Limited License

  • We grant you a limited, non-exclusive, non-transferable license to use the App for your personal use

  • This license does not include any resale or commercial use

9. Disclaimers and Limitations

9.1 Service Availability

  • We strive to maintain high service availability but cannot guarantee uninterrupted access

  • The Service is provided "as is" and "as available" without warranties of any kind

9.2 Limitation of Liability

  • To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages

  • Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim

9.3 Force Majeure

  • We are not responsible for delays or failures due to circumstances beyond our reasonable control

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

11.1 By You

  • You may terminate your account at any time by deleting the App and canceling any subscriptions

11.2 By Us

  • We may terminate or suspend your account if you violate these Terms

  • We may discontinue the Service with reasonable notice

11.3 Effect of Termination

  • Upon termination, your right to use the Service ceases immediately

  • We may delete your account and data, though some information may be retained as required by law

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or other reasonable means. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law and Jurisdiction

13.1 UK Users

For users in the United Kingdom, these Terms are governed by English law, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

13.2 US Users (Effective 2026)

For users in the United States (when service becomes available), these Terms are governed by the laws of your state, and disputes will be resolved through binding arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

17. App Store Terms

Your use of the App is also subject to the applicable App Store terms and conditions (such as Apple's App Store Terms of Service).

Apple App Store Specific Terms:

These terms between Volcanotes and you apply to your use of the App and acknowledge the following regarding Apple Inc.:

  • Apple is not a party to these Terms and is not responsible for the App or its content

  • Apple has no obligation to furnish maintenance and support services for the App

  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App

  • Apple is not responsible for addressing any claims relating to the App or your possession and/or use of the App

  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary

By using Volcanotes, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
